Malta Implements Equal Pay Transparency Directive 2026: Key Details and Impact
By means of Legal Notice 173 of 2026 the Government of Malta has implemented the Pay transparency Directive in a regulation entitled ‘Equal Pay (Transparency and Reporting) Regulations 2026, which comes into force just in time for the implementation deadline of the 7th June 2026.
The regulations come into force immediately as the Government did not opt for the usual 2 month ‘transitional period’ as we have seen in other legal notices published earlier this year.
The means that the main provisions in relation to categorisation for establishing equal value, the right to information (RTIs) and pay progression criterion come into effect immediately for employers of all shapes and sizes.
New provisions on transparency in recruitment are also present, although the rules which came into force in August of 2025 have not been repealed as yet.
The provisions of reporting, starting in 2027 are also present as are the extensive provisions on enforcement which are set to change the way in which litigation in this area is handled.
The regulations include interesting provisions on collective agreements, the use of the single source argument in claims of equal value and rules in connection with claims which arose prior to the 7th June 2026 are of particular interest.
